On Behalf of | Oct 25, 2018 | Products Liability |

When a Miami resident uses a product, they expect it to do what it is designed to do. Consumers assume manufacturers understand how important it is to create a safe product. When there is a negligent manufacturer that produces a product that results in a consumer injury, it can be unexpected and serious.

Millions of toilets have been recalled due to the risk of explosion. The toilets contained pressure-assisted flushing systems that burst in nearly 1,500 of the toilets. Total damage has reached over $700,000, and 23 people have been injured, including one who had severe injuries that required foot surgery.

The toilets are at risk of bursting near vessel weld seams and release built up pressure that has lifted the tank lid and shattered the tank. The units were sold nationwide at Home Depot and Lowes and through plumbing contractors and distributors. Millions of these toilets were already recalled for the same reason in 2012, 2014 and 2016.

There are some products that a person never expects they will be seriously injured while using. A toilet usually falls into this category and any toilet injury is unexpected. Manufacturers should understand that they have a duty to keep their customer’s safe.

When a person has suffered an injury due to a dangerous product, they may want to speak with a legal professional who specializes in products liability. An attorney can investigate the cause of the injury and figure out what happened. They can hold the manufacturer responsible for their negligence. Compensation may be available for medical expenses, pain and suffering, and other damages.

A manufacturer has the legal obligation to make sure their products are safe before they hit the market. Injured consumers have the right to hold these manufacturers responsible for their negligence.
